ANAC State Chapter Establishment Bill and duties of ANAC Officers.

ANAC State chapters shall be established for the purpose of bringing the
activities of ANAC to the states and districts. A chief State delegate/Chair
and two assistant chief State delegates/Chair shall head the Chapter. An
assistant executive director shall be nominated by the Chief delegate, with
the consent of the ANAC National Executive Director, who shall be confirmed
by the upper house of trustees or the house of delegates. The four officers
shall co-ordinate the affairs of ANAC in all areas at this State level, to
include recruitment, fund raising, other local activities of its interest,
and as directed by the ANAC Board of Trustees and House of delegates.
The chief State Delegate/Chair and two assistants, one senior and other
junior assistant, shall be elected by the members of ANAC in each particular
state, for the United States and Nigerian districts or states. The term of
office shall be two years. All State chapters shall report to the Upper
House of Trustees through its Chairman. The Upper house of trustees, shall
have the responsibility of maintaining the integrity of all State chapter
with the assistance of the House of delegates, through its President.
The Trustees shall have the ultimate and final powers in all confirmations
and appointments, in ANAC. When confirmation/s or appointment/s are in
question or challenged; the trustees, through its Chairman and a member of
trustee or three trustees may move the upper house to call a meeting within
30 days of such appointment or confirmation. The Chairman and or the
Secretary General with the Chairman's consent must call a trustee meeting
within 30 days of official receipt of such motion duly approved by the two
trustees, (Chairman and a trustee) or three trustees. Upon due
deliberations and an opportunity to all sides to be heard on the matter as
much as possible, the upper house will vote on the matter by a simply
majority vote. All such vote on matters shall be final on any appointment
and or confirmation.
At the inception due to lack of infrastructure in the different states, the
Chief delegates/Chair and two assistant Chief delegates/Chair, may simply be
vied for by existing members, delegates or Trustees of ANAC in a particular
States. The selection shall be the responsibility of the Chairman of ANAC
with advice and consent of the President of ANAC, and the Trustees of a
particular State, the officer of the Upper and Lower houses. Other delegates
from the particular State may be consulted at the discretion of the
president of the house. When there arise a conflict or disagreement in the
process or there is no clear consensus, the Chairman of the Upper house
shall submit all confirmed contestants names from the Chairman of Election
Committee to the the Upper House of Trustees for a vote and the highest
voted candidate would be selected for Chief Delegate, and two Assistant
Chief delegates.
The State Chapters of ANAC and its officers shall be allowed to keep up to
40% of funds raised for the purpose of running the State Branch of ANAC
while the 60% shall be remitted to ANAC national treasury from source.
Additionally, 20% of all annual membership dues paid directly to ANAC
National headquarters, for its state members shall be remitted back to the
state branch (or 80% of membership dues paid directly to the States chapters
forwarded to the National office). The state or district chapters are hereby
authorized to open ANAC accounts in their districts or local state. The
chief delegate and the assistant executive director shall have joint
signatories to the account. All accounts of the state and district chapters
are subject to regular audit and oversight of the Chief Financial Officer of
ANAC, the Finance committee, ANAC Treasurer, and other resolutions and
directives as granted by the Upper House Trustees and the House of
delegates.
For the purpose of maintaining the integrity and streamlining the activities
of ANAC, all correspondence between ANAC State Branches and outside parties
shall be copied to the Chairman Upper house of Trustees, Secretary General
of ANAC, President of ANAC and the Executive Director. The Executive
Director, the chief State delegate/Chair will be required in each session as
needed, to give a summary state of affairs of all state chapters to the
Upper house, lower house or a joint session of both houses and when
necessary the Chief delegate/Chair and his team may be called to give
account and or testimony on affairs of operations of a state chapter.
Removal/Dismissal of state chapter Executives
The Upper House of Trustees of ANAC shall have the power to remove the State
chapter executive with cause. Upon receiving a petition duly signed by one
third of all qualified state chapter members, or five serving delegates of
affected state, or two serving trustees, for removal, the Upper house of
trustees or the trustees through the Chairman may call a joint session of
both houses of ANAC, shall effect a fact finding investigation to confirm
the cause, if cause is justified, the Trustees shall commence the removal
proceedings with a due process hearing before the Trustees or a select Joint
Session (ad hoc), where the State Chief Delegate/Chair and or other State
officer/s shall present their case and be heard, then the Trustees or Joint
session shall decide the matter by a simple majority vote. The Chairman of
the Upper House with will appoint within 30days, new officer/s whose term
will continue until next scheduled election. This clause will apply to the
chief delegates, the assistant chief delegates and assistant executive
director collectively or individually, as the petition requires.
The Executive Director of ANAC (National office), the Chief Delegates of
ANAC State Chapters, or any other ANAC elected officer may appoint staff to
administrative positions for the effective functions of their offices in
accordance with budget and approved directives of both houses. If such
position is deemed executive, and requiring supervision of more than three
staff or with sensitive decision making authority, as in counsel, Public
relations officers, Executive Secretary, Trade reps, envoys, department
heads, representatives intelligence and security for sensitive functions,
high technology matters, scientific discovery matters, and other positions
of such importance, the appointment would require a confirmation by the
Upper House of Trustees, by a simple majority vote. The house of delegates
may confirm such officer's, as delegated from the upper house of trustees or
with consent from the upper house of trustees.
